Membership Terms & Conditions
This agreement is between yourself (“Benefit Participant”) and Family Value Savings and Health, and sets out the terms and conditions of Family Value Savings and Health programs which is administered by Family Value Savings and Health. This agreement shall be effective on the first day of the next month following the date of acceptance of the Benefit Participant’s application for enrollment in an Family Value Savings and Health program and payment of the enrollment fees.
Family Value Savings and Health programs are not insurance programs. Rather, they are discount programs whereby the sponsors of the program have negotiated to obtain discounts from the providers of the services and goods. No portion of any provider’s fee or cost will be reimbursed or otherwise paid by Family Value Savings and Health. Benefit Participant is solely responsible for payment of all provider fees and costs. Family Value Savings and Health’s only obligation under this agreement is to administer enrollment of the Benefits Participant and participating providers. Family Value Savings and Health discounts cannot be utilized in conjunction with any other discount program. Note to Utah residents: This contract is not protected by the Utah Life and Health Guaranty Association.
It is the responsibility of the Benefit Participant to call Family Value Savings and Health for a list of participating providers in the area, or to verify that a provider is a current participant in the program. Benefit Participant will always be responsible for payment for the services provided as well as related expenses. The actual benefits offered by Family Value Savings and Health may vary from state to state, and the list of Family Value Savings and Health providers is subject to change at any time without further notice to you. Family Value Savings and Health or its agents have inquired of participating providers to ensure appropriate credentials to provide the requisite services and goods, but may not have performed any additional inquiries as a result of the responses received, and assume no obligation to do so. Family Value Savings and Health and its administrators have no liability for providing services or guaranteeing services or the quality of services or goods delivered by the respective providers to the members or participants.
The actual savings you derive will vary, depending upon your location and the specific services or products purchased. Savings will be derived from a discount from the provider’s published fees, as the same may change from time to time. All fees listed or quoted by Family Value Savings and Health are based upon information which they believe to be accurate. However, all fees and prices are subject to change at any time without notice.
I understand that payment is due in advance of my membership period and that automatic payments begin the month after my membership is processed. My membership period begins on the 1st of the month and I will be charged/drafted on the 20th of the previous month for my membership period. I understand that it is my responsibility to ensure that funds are available in my account for the cost of my membership. I also understand that there is a minimum charge of $10 which will be billed to me if Family Value Savings and Health receives notice of any form of payment denial. I understand that Family Value Savings and Health is not required to notify me if my payment should be declined and that failure to pay all applicable fees by the end of the billing period will result in the cancellation of my Family Value Savings and Health.
I understand that I must give Family Value Savings and Health written notice of intent to cancel my Family Value Savings and Health in order to terminate my Family Value Savings and Health program and cease future charges. In accordance with this policy, any membership payments which are scheduled to occur within 10 days following Family Value Savings and Health’s receipt of my cancellation notice will remain in effect, but will cease thereafter. I also understand and agree that I am only eligible to receive a refund of my membership and registration fees paid if I provide Family Value Savings and Health with a written notice of cancellation within 3 days after signing this member enrollment form. If cancelled within 30 days I will be refunded plan fees only.
Member’s dependents are eligible to participate in Family Value Savings and Health under the primary member’s membership plan (based on what option was selected). Eligible dependents include the member’s spouse, unmarried children and step-children under the age of 18 or under age 23, if a full time student.
I you decide to cancel this agreement due to a modification of the Family Value Savings and Health program, the liability of Family Value Savings and Health shall be limited to a refund of membership fee paid for the period subsequent to the modification. This agreement constitutes the entire agreement between Benefit Participant and American Benefits Association. THERE ARE NO WARRANTIES; EXPRESS OR IMPLIED OTHER THAN EXPRESSLY STATED HEREIN. Benefit Participant hereby waives any claim he or she may have against Family Value Savings and Health attributable to ministerial or typographical errors.
This agreement may only be amended by Family Value Savings and Health in writing. Family Value Savings and Health may, if it deems necessary, assign its duties and responsibilities hereunder to third parties, and shall be relieved of any further liability hereunder. This agreement shall be governed and construed in accordance with the laws of the state of New Hampshire. Any dispute arising from or relating to the agreement shall be resolved by binding, non-appealable private arbitration, conducted in accordance with the rule of the Family Value Savings and Health. Exclusive venue for such arbitration shall be in New Jersey unless otherwise designated by Family Value Savings and Health or its successors. These provisions shall survive termination of membership in the Family Value Savings and Health., and sets out the terms and conditions of Family Value Savings and Health programs which is administered by Family Value Savings and Health. This agreement shall be effective on the first day of the next month following the date of acceptance of the Benefit Participant’s application for enrollment in an Family Value Savings and Health program and payment of the enrollment fees.

Privacy Policy
Family Value Savings and Health is serious about protecting your online privacy. This Privacy Statement explains our views and practices concerning privacy, and how they may pertain to you as a user of our system.

Collected Information We automatically collect and/or track the following:

2. Information knowingly provided by you through on-line forms, registration forms, surveys, and/or other entries, such as email addresses, personal, financial or demographic information;
3. Information, user specific or aggregate, on what pages our visitors access; and
4. E-mail addresses of visitors that communicate with Family Value Savings and Health via e-mail.

Use of Data Collected - We use your personal, demographic and profile data to enhance your experience at our site and to enable us to present content we think you might be interested in. We use your contact information to send you information about our company and promotional material from our partners. We may also use your personal, demographic and profile data to improve our site, for statistical analysis, for marketing and promotional purposes, and for editorial or feedback purposes for our advertisers. Information collected by us may be added to our databases and used for future telemarketing, SMS text-messaging, e-mails or postal mailings regarding site updates, new products and services, upcoming events, and/or status of orders placed online. 3. For marketing products and services which we determine, in our sole judgment, that you might find of interest. Any third party we share, rent, sell, or otherwise disclose data to will be prescreened by us, determined by us to be reputable, and will use the personal data for marketing products and services which we determine, in our sole judgment, that you might find of interest.

We Do Not Intend to Collect Data from Children - The information and services provided to us or our affiliates, sponsors, and advertisers are not intended to be viewed by children (under 18 years old). No information collected from children is knowingly used for any marketing or promotional purposes whatsoever, either inside or outside Family Value Savings and Health. No part of Family Value Savings and Health?s web site is structured to attract anyone under the age of 18.

Your Opt-Out Rights - You may opt-out of receiving communications from us and/or our affiliates by not submitting your information. We also allow you to remove your information from our marketing lists. If you remove your information from our marketing lists it will no longer be used by us to send promotional correspondence to you. You can remove your information from our marketing lists by sending your request in writing via email to opt-out@FamilyValueSavings.com.

Our Right to Contact You - We reserve the right to contact you regarding your account status and changes to subscriber agreements, privacy policy, or any other policies or agreements relevant to you.

Anti Spam Policy. Can-Spam Act Compliance - Family Value Savings and Health is dedicated to ensuring compliance with the ‘Can-Spam Act’, which took effect January 1, 2004. You may receive email from Family Value Savings and Health in the following circumstances:
1. Acknowledging your application has been received and requesting additional action.
2. Requests for additional information to support your current application.
3. Response to your inquiries regarding the status of your loan, payment due dates, extension requests and other transactional requests.
4. Thanking you for your valued business.
5. Advertisements for our products, services, changes in services, new product availability.
6. Advertisements for third party products and services where we have determined that such product or service may be of interest to our customers.
Section 10
To ensure compliance with the Can-Spam Act, Family Value Savings and Health has implemented the following guidelines for email delivery:
1. All emails sent to you by Family Value Savings and Health will clearly identify Family Value Savings and Health as the sender. FROM / SENDER: Family Value Savings and Health
2. The Subject Line of any email you receive will always accurately describe the subject matter of the email.
3. Any email from Family Value Savings and Health will include the ability to unsubscribe from future email messages.
4. Unsubscribing will ensure the customer is removed from ALL lists at Family Value Savings and Health; this excludes customer service emails regarding the processing and status of a current product.
5. Advertising emails from Family Value Savings and Health will include information that the email is an advertisement, either in the body or footer of the email.
6. Emails sent to you directly by Family Value Savings and Health will include an email address and physical address where you can send suggestions, complaints or other correspondence.
7. All third party marketing partners are required to comply with the Can-Spam Act.
